AVALIAÇÃO DE SEGURANÇA EM MÁQUINAS: Machine safety assessment: a comparison of the regulatory frameworks applied in Brazil and Portugal
Synopsis
The use of machinery and equipment remains one of the main causes of workplace accidents, necessitating legislation to ensure safety when working with machinery. Accordingly, this study aimed to compare the legislation in force in Brazil and Portugal as it applies to machinery and equipment. The methodology adopted in this study is qualitative, descriptive and comparative, based on documentary research and regulatory analysis. The results showed that the legal frameworks have different structures and organisation. The Brazilian standard, NR-12, establishes safety requirements for machinery throughout its entire life cycle, whilst in Portugal, the legislation requires a joint analysis of Decree-Law No. 50/2005 of 25 February, and Decree-Law No. 103/2008 of 24 June. Although the legal instruments in force in both countries cover physical safeguards, control and safety systems, electrical safety and power failures, signage, warnings and user information, amongst other aspects, the Brazilian standard NR-12 proved to be more comprehensive, also covering the deactivation and dismantling of machinery, training requirements, periodic inspections and technical responsibilities.
